1. Introduction
These Terms of Service ("Terms") and Privacy Policy ("Policy") govern the use of FortiVPS ("we", "our", "the Service"). By purchasing or using our VPS hosting services, you agree to these Terms.
FortiVPS is a privacy-focused hosting provider. We operate with no KYC, minimal data collection, and strict security practices.
2. Services Provided
FortiVPS offers:
- Virtual Private Servers (VPS)
- Security-hardened infrastructure
- DDoS protection
- 24/7 technical support
- Instant deployment
- Crypto and credit-card payment processing
Service availability may vary depending on datacenter resources and technical limitations.
3. Acceptable Use & Abuse Policy
This section defines acceptable use and prohibited activities on FortiVPS infrastructure.
You agree NOT to use FortiVPS for:
- Hosting, distributing, or operating malware, botnets, ransomware, stealers, phishing kits, or other malicious software
- Phishing, fraud, scams, carding, credential theft, or impersonation
- Launching, coordinating, or facilitating DoS/DDoS attacks
- Unauthorized scanning, brute-force attacks, exploitation, or intrusion attempts
- Sending spam, unsolicited bulk email, or abusive SMTP traffic
- Hosting illegal content or content that violates applicable law
- Activities that harm our infrastructure, IP space, reputation, upstream providers, customers, or third parties
FortiVPS may suspend, restrict, rate-limit, null-route, or terminate services involved in abuse, security incidents, illegal activity, payment fraud, or threats to infrastructure stability.
You are responsible for the security and maintenance of your VPS instance.
FortiVPS is not responsible for data loss, misconfiguration, or security breaches resulting from user actions.
Severe or urgent abuse may result in immediate suspension without prior notice.
4. Payments & Billing
We accept:
- Crypto payments (BTC, XMR, LTC)
- Credit cards (Visa, Mastercard, virtual cards) processed by third-party PCI-compliant payment processors
No KYC Required
Payments do not require identity verification.
Billing Cycles
- Monthly
- Annual
- Custom billing agreements may be available on request
Services may be suspended or terminated if payment fails, is reversed, disputed, fraudulent, or not received by the due date.
Payments are final and non-refundable, except in cases of provider error.
5. Refund Policy
Payments are generally final and non-refundable, except where required by law or where the issue is directly caused by FortiVPS.
Refunds are not available for:
- Services suspended or terminated for abuse or policy violations
- Fraudulent orders, chargebacks, or payment disputes
- Renewals that were not cancelled before the renewal date
- Crypto payment volatility, network fees, or incorrect payment details provided by the customer
- Customer-side misconfiguration, software issues, or security compromises
- Services that have already been heavily used
Approved refunds may be issued to the original payment method or as account credit, at FortiVPS’ discretion and depending on payment provider limitations.
6. Service Availability & Uptime
FortiVPS uses reliable infrastructure and strives to provide stable service. Unless a specific SLA is explicitly included with your plan, services are provided on a best-effort basis.
We are not responsible for outages or service interruptions caused by:
- Upstream providers or datacenter incidents
- Third-party network failures
- Scheduled or emergency maintenance
- User misconfiguration or customer-installed software
- External cyberattacks beyond reasonable mitigation capacity
- Abuse, suspension, or policy enforcement
- Force majeure events or circumstances outside our reasonable control
Customers are responsible for maintaining their own backups unless a specific backup service is explicitly included in their plan.
7. Account Suspension & Termination
We may suspend or terminate your service if:
- You violate these Terms or our Abuse Policy
- Your VPS is used for illegal, harmful, or abusive activities
- Payment fails, is reversed, disputed, or fraudulent
- Your usage threatens infrastructure stability, security, or reputation
- We receive a valid legal request requiring action
- Your service creates risk for FortiVPS, other customers, upstream providers, or third parties
FortiVPS does not suspend or terminate services solely because a customer values privacy, anonymity, or lawful political expression.
8. Limitation of Liability
FortiVPS is not responsible for indirect damages, loss of profits, loss of business, loss of data, reputational harm, customer-side security incidents, software issues, or misconfiguration.
To the maximum extent permitted by law, FortiVPS’ total liability for any claim is limited to the amount paid by the customer for the affected service during the one month preceding the incident.
9. Customer Responsibilities
You are responsible for:
- Securing your VPS, operating system, applications, credentials, and data
- Keeping software updated
- Maintaining your own backups
- Ensuring your usage complies with applicable law
- Responding quickly to abuse, security, or support requests from FortiVPS

11. Data We Collect
FortiVPS is designed with privacy and data minimization in mind. We collect only the data required to provide, secure, bill, and maintain our VPS hosting services.
We may collect:
- Account email address, which may be anonymous
- Payment status, such as paid, unpaid, failed, refunded, or disputed
- Payment transaction references required for confirmation and accounting
- Technical logs required for security, stability, fraud prevention, and abuse prevention
- Limited network metadata required to detect abuse, attacks, spam, service instability, or infrastructure issues
- Support ticket content when you contact us
- Service data such as assigned IP address, hostname, selected operating system, VPS plan, and service status
We do not intentionally require:
- ID documents
- Phone numbers
- Unnecessary personal metadata
- Unnecessary tracking data
Names, billing addresses, or additional payment details may be processed only where strictly required for billing, accounting, fraud prevention, payment processing, tax compliance, legal compliance, or by a third-party payment provider.
12. No KYC Policy
FortiVPS does not request identity verification by default. We do not request or store personal identification documents unless legally required or strictly necessary in exceptional circumstances, such as fraud prevention, payment disputes, abuse investigations, or compliance obligations.
13. Legal Basis for Processing
We process personal data only when necessary and based on one or more of the following legal grounds:
- Performance of a contract: to create accounts, provision VPS services, process orders, provide support, and manage billing
- Legitimate interest: to secure infrastructure, prevent abuse, detect fraud, investigate incidents, and maintain service reliability
- Legal obligation: to comply with accounting, tax, legal, regulatory, or valid law enforcement requirements
- Consent: where required, for example for optional cookies or optional communications
14. Payment Privacy
Crypto payments may store:
- Transaction ID (TXID)
- Amount
- Timestamp
- Payment status
Crypto payments store only the transaction reference required for confirmation, accounting, fraud prevention, and dispute handling. FortiVPS does not intentionally associate crypto transactions with real-world identities unless required by law or necessary to investigate fraud or abuse.
Credit card payments are handled by third-party PCI-compliant payment processors. We do not store full card numbers on our servers.
15. Server Logs
We maintain only the logs required for:
- Security
- Abuse prevention
- Service reliability
- Fraud prevention
- Legal compliance
- Infrastructure protection
VPS internal activity is not actively monitored. However, we may investigate traffic patterns, abuse reports, network metadata, or system-level indicators where necessary to protect our infrastructure, customers, upstream providers, or third parties.
16. Data Retention
We retain data only for as long as necessary for service operation, security, billing, accounting, legal compliance, fraud prevention, abuse handling, and dispute resolution.
- Account email: retained for the lifetime of the account, then deleted or anonymized after account closure unless retention is required by law
- Billing and invoice records: retained for the legally required accounting and tax period
- Payment transaction references: retained as long as necessary for payment verification, accounting, fraud prevention, and dispute handling
- Security logs: generally retained for up to 90 days unless required for abuse investigation, fraud prevention, legal compliance, or infrastructure protection
- Abuse reports and related evidence: retained for as long as necessary to investigate, respond, defend our rights, or comply with legal obligations
- Support tickets: retained for up to 24 months after closure unless earlier deletion is requested and legally possible
17. Third-Party Processors
We may use third-party providers strictly necessary to operate the service, including:
- Payment processors
- Billing software
- Transactional email providers
- DDoS mitigation providers
- Hosting, network, and infrastructure providers
- Support ticket systems
- Security and monitoring tools
These providers may process limited data only as necessary to provide their services. We do not sell, rent, or trade user data. Each provider follows their own privacy practices. We choose providers that respect user privacy.
18. Cookies & Tracking
FortiVPS uses only essential cookies for:
- Session management
- User authentication
- Account security
- Customer portal functionality
We do not use advertising cookies, behavioral tracking, or third-party analytics cookies.
19. Data Sharing
We do not sell, rent, share, or trade user data.
Data may be disclosed only:
- To service providers required to operate FortiVPS
- To investigate or stop abuse, fraud, spam, phishing, malware, attacks, or other harmful activity
- To upstream providers where necessary to resolve abuse or network incidents
- In response to a valid and legally binding request from competent authorities
- Where required to comply with applicable law or defend our legal rights
20. International Transfers
Some providers may be located outside your country or outside the European Economic Area. Where required, we take reasonable steps to ensure appropriate safeguards are in place.
21. Your Rights
Depending on applicable law, you may have the right to:
- Access your personal data
- Request correction of inaccurate data
- Request deletion of your data
- Request restriction of processing
- Object to certain processing
- Request data portability
- Withdraw consent where processing is based on consent

22. Supervisory Authority
If you are located in the European Union and believe your data protection rights have not been respected, you may contact your local data protection authority. If FortiVPS is established in France, the competent authority is the CNIL.
23. Policy Updates
We may update these Terms and Privacy Policy from time to time. Material changes will be announced on our website or through the customer portal where appropriate. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
